1) Introduction
Welcome to EMT Engraving ("we", "us", "our"). These Terms and Conditions govern any custom hand engraving work (the “Service”) provided by us to you ("you", "customer"). By placing an order, you agree to be bound by these Terms.
2) Quotes and Estimates
- Quotes are dependent on and interwoven with the design process. The final price and timeline will be established only after we review and agree on the design concept.
- An initial design concept discussion is required to generate an accurate quote. This can occur either in person by appointment, or by phone and email if in-person isn’t possible.
- We may discuss the size, metal type, engraving text/artistic design, placement, and finish preferences. Repairs may be included, and we can discuss whether you would use our repair services prior to engraving or re-engraving your piece. We may discuss sourcing a new piece.
- Once a design concept is agreed and a design proof is approved, a formal quote will be provided reflecting the scope, materials, and any required revisions. This formal quote becomes the basis for the deposit and schedule.
- Estimates are valid for 7 working days from the date of the initial concept discussion, after which they may be revised to reflect any changes in scope, materials, or timing. This period is short due to the current uncertainty and fluctuations in metal prices.
- If the scope, design, or metal changes after approval, we reserve the right to adjust the price and timeline accordingly.
3) Custom Work Process
Our step by step workflow is summarised below Please refer to our Section 'Custom Work Process' for a full outline:
Step 1: Concept discussion, initial price and timeline estimate
Step 2: Sketches (if they were required as part of our initial discussion, for a small one-off fee)
Step 3: Refinement, Final Design and Final Quote
Step 4: Deposit and Schedule
This process is integrated with the general Terms and Conditions. Where the Custom Work Process specifies sketch fees, deposits, proofs, revisions, or delivery times, those specifics apply to your project.
4) Payments
Prices are in AUD plus 10% GST.
Returns or refunds are governed by these Terms; see section on returns.
Payment methods: By bank transfer
5) Timeline and Delays
Standard turnaround: 25 business days from design approval or deposit receipt.
Rush orders: A rush fee of 15% of the total order price applies. A confirmed completion date will be provided, subject to material availability. Please be aware that this is a small business, where time equals quality of outcome.
Delays may be caused by design editing, changes in metal availability, or external factors beyond our control. We will notify you promptly of any delays and adjust the timeline accordingly.
6) Revisions and Cancellations
Included revisions: We include up to three rounds of design revisions after the initial proof.
Additional revisions: Each additional revision may incur a fee of $60
Cancellations: You may cancel before engraving begins. If engraving has begun, you may be responsible for a portion of costs incurred, including a non-refundable portion of the deposit and materials.
7) Quality and Warnings
We will inspect items before engraving and notify you of any issues that could affect the result. Our workshop has a master jeweller who can provide repair and resizing services. If an item is deemed unsuitable for our services, we will discuss alternatives or refuse the project
The final product may differ slightly from proofs due to material behaviour and hand engraving characteristics (i.e. human hands are used, which brings flexibility that machines can’t provide, but also a human quality due to pieces being unique and often one-off in design).
8) Finishes and Care
Finishes: Polished finish (standard). Other finishes may be available on request. Finishes may alter appearance and require maintenance.
Care instructions: We provide care guidance. We are not liable for damage due to improper care or use.
9) Ownership and Intellectual Property
You retain ownership of the engraving design you provide (text or artwork you supply).
We retain ownership of our own design concepts, images, sketches and drawings.
Unless requested otherwise, completed commissions may be photographed and documented as part of the EMT Engraving archive, portfolio, and promotional material. If you would prefer your commission to remain private, I'm very happy to accommodate this - simply let me know before work begins.
10) Shipping, Delivery, and Risk of Loss
Delivery: [Options: in-person pickup, insured shipping, delivery window].
Risk of loss passes to you when the item is handed to you or the carrier, depending on the chosen delivery method.
We are not liable for shipping damages caused by carriers. We’ll assist with insurance claims if applicable.
11) Returns and Warranties
Custom engraved precious metal items are typically non-returnable unless there is a defect in craftsmanship.
If a defect is discovered within 10 days of delivery, please notify us with photos and a description. We may offer repair, replacement, or a refund at our discretion.
Warranties cover workmanship for 1 month from delivery. Damage due to misuse, modification, or improper care is not covered.
12) Privacy and Data
We collect personal information required to complete your order (name, contact details, shipping address, payment info).
We do not sell your data. We may use your information to contact you about your order, promotions, or future services if you opt in.
We store data securely and comply with applicable data protection laws.
13) Liability Limitation
Our liability for any claim related to the Service is limited to the amount paid for the order.
We are not liable for indirect, incidental, or consequential damages arising from the Service.
14) Force Majeure
We are not liable for delays or failures arising from events beyond our reasonable control (e.g., natural disasters, pandemics, supply shortages).
15) Governing Law and Disputes
- These Terms are governed by the laws of South Australia and Australia.
- Any disputes will be resolved in the courts of South Australia, or via binding arbitration if agreed by both parties.
16) Changes to Terms
- We may modify these Terms at any time. Material changes will be communicated to you. Your continued use of our Service after changes constitutes acceptance of the new terms.
